A cease and desist letter is a formal warning: stop, or I’ll take legal action. It isn’t a court order, but it creates a paper trail and resolves many disputes without a lawsuit.

When to send one

  • Someone is using your photos, writing or logo without permission.
  • A neighbor, ex or former business partner is harassing you.
  • Someone is spreading false statements that hurt your reputation.
  • A former employee or contractor is breaking a non-compete or NDA.

Tips for a letter that works

  1. Stick to facts. Dates, URLs, screenshots: no insults or threats you won’t carry out.
  2. Be specific about the demand and set a clear deadline.
  3. Keep evidence before you send it; content often disappears once the letter lands.
  4. Send it provably: certified mail with return receipt, plus email.

When to use a lawyer

A letter on a law firm’s letterhead carries more weight, and some situations (threats of violence, large financial losses, trademark disputes) need a lawyer from the start. For online copyright issues, a DMCA takedown notice to the host is often faster.

Frequently asked questions

Is a cease and desist letter legally binding?

No. It’s a demand, not a court order. But ignoring it can help you later show the conduct was willful.

Can I send one without a lawyer?

Yes. Anyone can send a cease and desist letter.
